Organisations may have to collect and use personal data for operating their business activities in Mainland China. Unlike Hong Kong (the PDPO) or other places such as the EU territories (the GDPR), PRC does not have a single and consolidated set of data privacy law which is currently in force. Its data privacy related laws and regulations are scattered around different pieces of existing legislations (eg 網絡安全法, 電子商務法 & 兒童個人信息網絡保護規定).

But with the issuance of the Draft Personal Information Protection Law in October 2020, there is a possibility that PRC may also have its single set of legislation which comprehensively regulates the protection of personal data in the near future.      

Through this webinar, we will give you a general introduction on some of the existing data privacy related laws and regulations as well as the Draft Personal Information Protection Law in PRC.

 

About the speaker

SACHA CHIU, Manager of Risk Advisory, BDO

Sacha has been working in the legal and compliance fields for around 10 years and he is experienced in handling data privacy matters. Prior to joining BDO, he worked at some private companies in legal and data protection related capacities which covered diverse business nature eg telecommunications, airlines, cinema & ticket sales platform and banking.

Apart from the commercial sector, he had also been working at the regulator, Office of the Privacy Commissioner for Personal Data.

His experiences with regard to data privacy compliance cover the following areas: compliant handling and investigation, developing and reviewing internal guidelines and personal information collection statements, handling data access requests, data privacy risk assessment, data breach incidents monitoring & remedial action recommendations, and data privacy issues advisory.
